Terms of the public offer
PUBLIC OFFER (SALE AND PURCHASE AGREEMENT)
This document constitutes an official and public offer by the Sole Proprietor Turchak Anatoliy Oleksandrovych (hereinafter referred to as the "Seller") to conclude a remote Sale and Purchase Agreement for goods. This Agreement is addressed to any individual or legal entity (hereinafter referred to as the "Buyer") who accepts (takes) the terms and conditions of this Offer.
Full and unconditional acceptance (accommodation) of the terms of this Agreement shall be deemed to be the execution by the Buyer of any action demonstrating the intent to purchase Goods on the Seller's Website (including, but not limited to: placing an order through the shopping cart, one-click ordering, making a phone call to place an order, or making a payment for the Goods).
1. GENERAL PROVISIONS AND DEFINITION OF TERMS
Website — the Seller's internet resource where the assortment of Climate control equipment and ventilation spare parts offered for sale is presented.
Goods — ventilation and climate control equipment, accessories, spare parts, and other items, information about which is published on the Website.
Offer — this public document containing all the essential terms and conditions of the sale and purchase agreement.
2. SUBJECT OF THE AGREEMENT
2.1. The Seller undertakes to transfer ownership of the Goods, selected and ordered in accordance with the terms of this Agreement, to the Buyer, and the Buyer undertakes to accept the Goods and pay their price under the conditions specified below.
2.2. The Agreement regulates the legal relations between the Seller and the Buyer from the moment of order confirmation and remains in force until both parties fully perform their obligations.
3. ORDERING PROCEDURE
3.1. The Buyer independently selects Goods on the Website and places an Order using the shopping cart interface or by contacting the phone number +38(093)314-36-09.
3.2. When placing an order, the Buyer provides up-to-date personal data necessary for delivery and identification (Full Name, phone number, address or carrier's branch number, and payment method).
3.3. In case the ordered Goods are out of stock, the Seller has the right to contact the Buyer to suggest an alternative or cancel the item with a full refund (if prepayment was made).
4. PRICE OF GOODS AND PAYMENT TERMS
4.1. Prices for the Goods are indicated in the national currency of Ukraine — Ukrainian Hryvnia (UAH), and are valid at the time the order is placed.
4.2. Payments for the Goods can be made by the following methods at the Buyer's option:
Cash on delivery (payment upon receipt) at the branch of the logistics operator.
Bank transfer (payment to the Sole Proprietor's bank account according to the issued invoice).
Online payment via the integrated payment system LiqPay.
4.3. In case of bank transfer or online payment, the order is processed and prepared for shipment only after the full amount is credited to the Seller's account.
5. TERMS OF DELIVERY AND RECEIPT OF GOODS
5.1. The Buyer may choose one of the following options to receive the Goods:
Delivery by the logistics company "Nova Poshta" (at the carrier's rates at the Buyer's expense, unless agreed otherwise individually).
Self-pickup from delivery points by prior arrangement with the Seller.
5.2. Along with the Goods, the Buyer is provided with the payment settlement documents and warranty certificates prescribed by legislation.
5.3. The risk of accidental damage or loss of the Goods passes to the Buyer at the moment the consignment note is handed over (for self-pickup) or when the Goods are issued by a "Nova Poshta" representative. The Buyer is obliged to check the integrity, completeness, and appearance of the Goods directly at the carrier's branch.
6. WARRANTY COMMITMENTS
6.1. All Goods presented on the Website are covered by warranty obligations. The warranty is provided by both the direct Manufacturer of the equipment and the Seller.
6.2. The warranty period is specified in the warranty card or technical documentation attached to each specific unit of Goods.
6.3. Warranty service is not provided in case of violation by the Buyer of the operating rules, installation of climate control equipment without involving certified specialists, or presence of mechanical damage.
7. RETURNS AND EXCHANGES
7.1. The Buyer has the right to return or exchange Goods of proper quality within 14 calendar days, excluding the day of purchase, in accordance with the Law of Ukraine "On Protection of Consumer Rights".
7.2. The return of Goods of proper quality is possible provided that:
The Goods have not been used, their marketable appearance, consumer properties, seals, labels, and original packaging are preserved.
A payment settlement document (receipt) issued with the Goods is available.
7.3. The cost of return shipping for Goods of proper quality shall be borne by the Buyer.
7.4. Refunds are made by the Seller within up to 7 banking days from the moment of receipt and verification of the returned Goods at the warehouse.
8. CONFIDENTIALITY AND COOKIES
8.1. The Seller ensures the protection of the Buyer's personal data in accordance with the applicable legislation of Ukraine.
8.2. Use of Cookies: The Buyer is notified and agrees that the Website collects and uses cookies to optimize website performance, analyze traffic, and improve customer experience. The Buyer can disable cookies in their browser settings.
